The presentation will explore the growing legal and regulatory risks for organisations that suffer data breaches and personal information loss, with a focus on both Australian law and emerging international legal trends. Each of the following topics will be discussed: 

(a) understanding the obligations to protect personal information imposed under Australia's Privacy Act and the scope of Australia's incoming Mandatory Data Notification laws; 

(b) regulators' expectations in Australia that organisations protect data and the types of regulatory action that can be taken against organisations following data breaches;

(c) the third party legal liabilities that organisations are exposed to following data breaches; and

(d) legal strategies for intrusion management and data breach responses.
